Who was Aldo Mario Bellei, and why should Donald Trump care and Harvard Professor Laurence Tribe know? Because Mr. Bellei puts the lie to Donald Trump's attack on the eligibility of Senator Ted Cruz to be president backed up by Professor Tribe's claim that "[t]he Supreme Court has never addressed the issue.

Ref: “Does he have an American birth certificate?”

Ted Cruz should have two birth certificates. He should have a Canadian birth certificate issued by the city/county/territory where he was born and a “Certificate of Live Foreign Birth” issued by the US State Department showing he was born an American citizen in a foreign country.

I am familiar with this as I was born in Canada while my parents were stationed there in the 1960s. I was issued my US Certificate of Live Foreign Birth after my dad was stationed in the US.

That’s why “birthers” we’re universally mocked. And they continue to deserve it.

Those words are hard to use and easy to mix up. And then “infer” and “imply” sort of look and feel alike (in a way , they are quite alike, both are used to denote “premise to conclusion”). Most people don’t notice a misuse, and it’s not a faux pas.

Under the references you provide, women are not even considered citizens,

You claim Ted Cruz citizenship derives from the Constitution. This from the Department of Justice. photo image_zpskwkqejgp.jpeg

That seems to be the English Law understanding of Natural Born.

Then their is a naturalized citizen which can include people born outside the country, but who immigrated into this country.

Then there are U.S. citizens whose parents are here illegally. But are they Natural Born of Mexico? That is the country of which they are citizens were they born there. They would be Natural born Mexicans, but they cannot be Natural born of two countries. Or can they?

According to the Constitution, who defines citizenship? Congress.

Where?

Please be specific and cite the exact Article, Section and Clause which proves your assertion...The Constitution of the United States

They do that by Laws.

According to my understanding of the Constitution, in regards to citizenship, all Congress can do is "...establish an uniform Rule of Naturalization..." (Article 1, Section 8, Clause 4).

Now, that makes aliens into American citizens, but that Clause doesn't say Congress "defines" citizenship.

Any help greatly appreciated.

Oh, BTW...a natural born citizen needs no recourse to a positive law (laws passed by Congress are positive laws) like an alien does.

Your item “k’ (I assume you meant 4, is considered natural born)

IE: Citizenship is acquired and well understood. The parent being natural born (cruz’s Mother) cannot transfer a different citizenship to the child. (perhaps by Voodoo)

We can go round and round......but I don’t intend to.

What we do know is that citizens are either citizens at birth, by the definition in law, or they have to follow naturalization procedures to become citizens.

If you do not have to be naturalized, you are natural born.

No, but natural born and native born have different meaning.

The mistake is to assume they are the same.

Natural born is a status or state of being.

Native born is a place.

...considered as natural born citizens.

You really don't know what that actually means?

All it means is that they would enjoy the same equal protection under the law as a natural born citizen.

Why would I...

They don’t discern or enforce or make constitutional rights.

They enforce statutory law. Just like the IRS...

The venue for this argument is SCOTUS, but a case, or this case, has to make it to the Appellate court and be ruled on. To start the process you need standing to bring suit.

That can’t happen until after Cruz is elected.

WE? Speak for yourself! What you're stating is what you believe.

THE LAW only governs foreigners/aliens (naturalization). Congress can't enact a law they're not even empowered to draft.

He’s not native born. But once the transfer of citizenship takes place he is considered “as” a native. but not native born.

Are you following me? or just parsing what I say so you can post more stuff?
