You saw what Congress did with the Resolution on McCain (post 100). I am not too sanguine that Congress will pass something that will pass Constitutional muster. In any event, whatever Congress passes could be challenged in the courts.

Believe me, there are few who have less confidence in this entire Congress, and in the courts, than I do.

And still, I think Congress should clarify the matter.

If the courts ever find an opportunity to chime in, that’s their prerogative, I suppose.

But in the end it is We the People who cast the votes and elect the electors, and Congress who is constitutionally responsible for tallying them. The courts are virtual bystanders to that process, ideally.

Notwithstanding Bush vs. Gore and rare court cases of that sort when the courts are asked to play referee.
