Again, Article I, Section 8, Clause 4 of the U.S. Constitution gives Congress the power to alter the immigration rules as it chooses. In the meantime, although it’s not a judicially “settled” issue, there is a strong argument for deportation of the baby with the illegal-immigrant parents both legally and morally. The moral argument for non-citizenship of the baby of illegals is one of keeping the family together. If the parents have immigrated illegally, then sending the parents and the child back keeps the family together, a much more humane result than forced splitting up of the family.
