I think it will be 6-3, as well. Kennedy and probably Roberts will vote with Ginsburg/Kagan/Kennedy/Sotomayor. Alito might, but I think probably not. Scalia and Thomas will dissent.
Just realized they release rulings on Mondays and Thursdays. If they want to make a ‘statement’ about SSM, and since June is “Pride Month”, they’d need to do it either tomorrow or Monday.
God help us.
Hope those who vote for it regret it the rest of their lives. God has a way of dealing with hubris.
They will rule it’s mandatory?
Roberts view of a court that defers to the political branches will likely vote there is no right for same sex marriage, meaning this one will come down to Kennedy.
I don’t see any way they overturn all these nullifications of state laws and amendments. The best we can hope for is that they somehow define the issue narrowly within the actual law. That somehow they say because the government provides services and tax breaks to couples, they have to apply the same to a gay couple, but that states have leeway to define it in a matter seen fit. Also some sort of religious freedom discussion. That is highly optimistic, but it’s the best we should even hope for. .
