If he was “under the influence”, passed out, immobile in a parking lot, what would he be charged with?

With the engine running, he’s dead-to-rights DUI. This is a case where I agree with it. Dude is extremely drunk and it’s obvious that he drove to get there. Where I don’t agree with it is like the time that a Navy buddy of mine got a DUI in his driveway while showing his friend his new car stereo. Local police make a lot of money off DUIs and underage alcohol tickets, that’s why they’ll do anything to find them create them. Contrast that with how you get treated when your car is broken into or vandalized and you need a police report for the insurance company. The cop shows up 3 hours later and acts like you’re making him scrub your toilet.
