Once its digital (Especially a smartphone probably set to automatically be sent "in the air") and uploaded its not private, its just waiting to be plucked/good old fashioned ignorance no matter what your service provider promises in terms of privacy.
Its the equivalent of taking nude Polaroids and putting the pics in a safe where perverted trolls already have residences inside the safe.
If one sells these pics there is a crime along with the original breach/hack. Once released in the wild, its too late for tears...
