It's up to the Grand Jury and Eric the Red to deterine if he will be charged.

The County and State DA will have little influence.

Barring federal interference, couldn’t the DA simply choose not to even present to a grand jury?

A grand jury may well choose not to indict on criminal charges, but if that happens, you can make book that the policeman will face Federal civil rights violations charges. It is the Chicago way you know.
