I predict that a customer saw him holding the toy gun, panicked, and embellished the story.

Then the police shot him on sight.

They yelled "Get on the ground" so they could write in their report that they told him to get on the ground. They would just fudge the order of events a smidgen.

I wonder if he was dumb enough to actually point the gun at the police, like he was going fire it.

The video will show what happened.

Could be. But the real story is that he opened a Crossman in sporting goods, was pointing it at people, wouldn’t put the gun down and pointed it at the police.

Death by cop.

Wal-Mart video records every square inch of the store 24 hours a day, for liability reasons, mostly from customers but also from employees. And even when the store is closed and empty, in case anyone breaks in.

I thought at first they were talking about the toy section, but I know with my eight year old there are only Nerf guns there. We get all of his good toy AKs and M16s at Freds and General Dollar

I almost picked up a toy pistol in Wal-Mart myself today. Was in a clearance aisle-end section.

Someone is going to get smart and call the police on an undercover in Walmart claiming a nut with a gun,
then call the undercover and tell him that two men posing as officers are robbing
people in front of the store.

You are right. From his reaction it seems the first time he noticed the police was after he was shot. They are off screen, but he does not turn towards them or point the weapon towards them. He seems to run back towards the weapon after being shot, but they may have been fear (how can you think logically if you had just been shot out of the blue).
