While I am not defending the woman who was shot, I do think this one goes beyond self defense (assuming, of course, that the actual facts are as presented). If you pull a gun, and the assailant flees, you are NOT justified in shooting at that point. If he had shot while being tackled by the assailants, that’s a different story. If the assailant is fleeing, there’s no longer a threat to his life or well-being, so shooting seems to be an act of retribution, not one of self defense.
Yes, basically he screwed himself big time by opening his mouth. This reminds me of that case last year of the guy who shot the two teen who broke into his house. He opened his mouth, said he was setting a trap, shot them before they made any threat blah blah, he even tape recorded it while he shot them. Now he’s doing life in prison, freakin idiot.

You can shoot to protect your property under certain circumstances here in Texas, especially at night.I don’t believe many other states have these provisions, though, and I’d be surprised if California does.
If the facts are as presented in the article, then the old man murdered that woman. She was shot when she stumbled in an alley as she tried to flee.
