You seem to believe it applies only to the SUSPECTED law breaker... at least from the law books and legal definitions as determined by you. He would have choked, maybe vomited mucus, gasp for air, but a couple of cups of water would wash it away.
Bears live with no help in washing it off, and leave all the time. The main thing is they do not want to be sprayed again so calm down and leave.
People are incapacitated but alive and after 30 minutes of water washing (or so). They are then very compliant.
