Jury Decides on Four of Five Counts in Loud-Music Murder Trial

urors in the trial of a white Florida man who fatally shot a black teenager over loud music said on their fourth day of mulling the case that they reached a verdict on four of five counts, but cannot come to a consensus on one count of first-degree murder.

Michael Dunn, 47, says he was acting in self-defense when he shot at an SUV 10 times while parked next to four teens at a Jacksonville, Fla., gas station in November 2012.

The shots killed Jordan Davis, 17, of Marietta, Ga. Dunn is charged with first-degree murder, three counts of attempted murder and one count of firing a deadly missile into an occupied vehicle.

Wonder why the police didn’t follow any of this up until weeks later ?

One reason might me that they didn't find out about it until a couple of days later when they finally found Dunn and he gave them his side of the story. Had he remained at the scene and talked to the police right from the beginning then a more thorough search for the gun might have been made. Not that it would have found anything since there is no evidence a gun was present to begin with.

State will retry him on the murder one count

Murder one was a bit of a stretch to begin with. Can they recharge him with murder two? Or since it was a mistrial are they stuck with retrying it as murder one or not at all?

I consider it my responsibility to stay out of any kind of spat that might escalate - arguing opens the door to being "dissed", which too many consider to be "just cause". I'm willing to be dissed and take verbal abuse if it means a situation won't escalate to a physical confrontation.

Rational people who carry a gun do so for self-defense. Idiots like Dunn carry one so that they feel brave enough to initiate conflicts whenever they feel annoyed at someone or something.

Fair enough dmz. I have heard more about the case today. Perhaps this guy was out looking for trouble. Heck perhaps both were. Interesting about the bac. This incident should not have happened.

they had lesser included so they can chose... my guess is they thought since he went back to his car that was sufficient to form intent

Then why the convictions on the attempted murder charges? It's more likely, as someone pointed out earlier, that the jury was deadlocked on whether to convict him of first degree murder or second degree murder and couldn't come to agreement.

The jury’s decision seemed consistent. One can be guilty of attempted murder and not have it be first degree. Your second point is exactly what happened.

I listened this morning to ABC News and they were theorizing that atleast one person held out for self-defense on the Jordan Davis count, believing that the first 3 shots that killed Davis were self defense but that the following 7 shots were excessive.

It is hard for me to even comprehend how they could come up with that reasoning other than the fact that they had an ulterior motive.
