The Supreme Court created a “fourth” type of citizenship in U.S. v. Wong Kim Ark, when they made a distinction between natural-born citizens and 14th amendment “citizenship by birth.” The court said the 14th amendment does NOT define natural-born citizenship. The court cited NBCs as a separate class of citizens than those persons born on the soil without regard to the citizenship of the parents. The court affirmed that NBCs do NOT need the 14th amendment to become citizens AND they confirmed that citizenship by birth via the 14th amendment only applied to the children of resident aliens.
