In a perfect libertarian world a company should have the right to hire or fire anyone they want for any reason they want. They should also have the right to choose their customers and to refuse service to anyone for any reason.

We have become so used to the government dictating who we can hire and who we can fire and who we can sell to and who we can buy from that we have lost all of our sense of Liberty.

You should applaud the company for having principles and refusing to hire you because they don’t like your looks, the color of your shirt or the smell you emit when you walk into a room of non-smokers.

Instead you apparently are looking for advice on how you can sue them for discrimination.

As an attorney I would advise you to look for work elsewhere.

As a liberty loving conservative I would advise you to send a letter to the company thanking them for having principles even though those principles conflict with your chosen lifestyle. Then tell them that if you are someday able to kick the smoking habit, that you would consider it an honor to come to work for them.

I disagree, I should be able to exercise my rights off the job with no consequence to my employment.

I will not send them a letter thanking them. The stigma against smokers is becoming a fascist crusade to punish anyone that likes to smoke.

What about the people that REEK of cologne/aftershave.perfume, or have bad hygiene or medical issues that cause them to stink?

What about someone that is bald? Or ugly? Or obese?

You think an employer should be able to dictate what their employees eat, watch, drink, where they sleep, or get entertainment? You’re walking a slippery slope I think. Banning smokers from working sets a dangerous precedent to take away more freedoms.

What will you say when employers require you to have an RFID chip implanted into your hand or forehead so they can deposit your $ into. I imagine it will be “employers should be able to hire and fire anyone they want”.

There is a legitimate question based on the book of revelation that suggests there is a line beyond which refusing to allow a person the ability to buy and sell becomes ungodly.

That line is the refusal because you refuse to give your heart, strength, mind, and soul to anyone but God.
