It wasn't Lakin's lawyer, it was the son of John Hemenway, who filed a suit against Obama but who is not connected in any way with Lakin or his case. His death appears to have been ruled a suicide.

No, under the manual for courts martial, the burden is on the person alleging the order was unlawful. However, that person must be given the opportunity, and thus the access to information, to make that case, at trial.
It apparently worked: Petraeus later described himself as "chagrined," and both he and Gates "swore loyalty" to the President.
I hope that is literally true, and they did not swear loyalty to Obama/Soeto/Dunham or whoever he really is.
The Constitution makes the President the commander in chief, and the military is supposed to take the lawful orders of the commander in chief. However they are not required to kiss his ash either. They serve at his pleasure and he is their commander.
The President that is. The question remains; "Is BO lawfully, that is Constitutionally, the President, or just an ineligible usurper sitting in the Oval Office and acting as president."
He's not exactly lived up to his promises of transparency on this issue, or many others for that matter.
