Not true, you can buy it within 6 month of when you previous 2 year Iphone contract will expire.
If he bought it in January, the soonest he can upgrade with the upgrade price is July of 2011.
I bought mine June of 2009, so I have to wait til Dec of 2010 before I can upgrade.
