A plaintiff has to demonstrate that the defendant’s actions directly caused injury, that the injury is unique to the plaintiff, and that there is a legal remedy. You can’t sue someone for what they should have known if they didn’t have an obligation to act. You’re the one doing the picking and parsing to suit your purpose.
