If he only shot the kid once then fine, but coming back and shooting him five more times when the kid was knocked out already. Hate to say it, but he should be charged with murder.

Charged with murder???? Based on what exactly?

You have seen video where the perp was not moving? I have followed this case and have seent he video and nothing backs up the DA’s claim.

He should be charged with something for last five shots, but first degree murder is excessive. There must be a lesser charge that is more appropriate.

HANG ON..didn’t the pharmacist say the kid was struggling to get up and he (pharmacist) feared the kid wasn’t done yet?

when was he determined to be unconscious and by whom?

The video does NOT show the perp on the ground. He may have made a sudden move or have been going for a gun. Hindsight is 20/20. The pharmacist didn't know. AND YOU HAVE ABSOLUTELY NO RIGHT TO CRITICIZE ANYTHING BASED UPON THE AVAILABLE EVIDENCE.

You should hate to say it because it’s absurdly illogical. You don’t know the “kid” (the criminal), was knocked out. You don’t know if appeared to be a threat despite debilitating injuries. You don’t even know if he may have actually been a threat despite being shot in the head. There are have been criminals shot in the head that still returned fire.

I saw the video and it looks like the pharmacist chases the other perp out of the building and then comes back in and shoots the downed perp again.

Adrenalin is not a sufficient defence for this behavior, IMO. He should have just held him at gunpoint until police and ambulance arrived.

The kid WASN’T knocked out. The statement from the defendant said that the kid tried to get back up after the first shot.

Really, what if the kid was already dead? I suspect desecration of a dead body is not a crime.

DA will charge him with first degree murder with no lesser included offenses so that the jury will have no choice but to aquit him. I doubt this case would get past a grand jury regardless.

Absolute bull. You are separating scenarios to fit your conclusion. The whole thing happened at once, and after the guy went down he seemed to be reaching for a gun, which the other perp did in fact have. Multiple shots to make a deadly threat STOP is not only justified, but supremely rational and taught to those people who wear badges, too. Notice how many police shootings involve the emptying of entire magazines, by multiple officers, into the perp? It ain't an accident. In a case where deadly force is justified - it's justified. And that means making broad allowances for the fact that the justification is based on threatening someone's life, and self-defense consists in MAKING SURE that threat is GONE.

Why? He is not a trained prisoner keeper of any sort. Why should he place his life on the line to save the perp’s life?

If you don’t want to get dead don’t assault other people.

If I were a jurist that man would walk free and with my apologies. I wouldn’t care if he chased the predator down 10 blocks to shoot him.
