Prosecutor Says Omaha Shooting was Justified

Douglas County Attorney Don Kleine says the owner of Midwest Grillz and Jewelry in Omaha shot and killed two people, but calls the shooting justified.

Sixteen-year-old Marcel Davis and 29-year-old Willie Wakefield were found dead inside the store. A third person, 22-year-old Brandon Boyce was shot in the abdomen.

Davis and Wakefield went to Midwest Grillz at 62nd and Ames late Tuesday to pick up some gold plated teeth. Kleine says Wakefield was upset about the “grills.” He pulled a 9mm gun and fired two shots at store owner Andre McKesson.

Kleine says McKesson returned fire with an SKS rifle; getting off more than a dozen shots. 16-year-old Marcel Davis was not armed.

Police are still looking for a fourth witness to the shooting. According to Kleine, investigators have been told varying stories about what happened. At this time, he is not pressing any charges against Andre McKesson.


Count the number of parties involved
1 = Store owner
2 & 3 inside store for ‘grillz’
4 = just outside door - late evening
5 = “witness” police are looking for (aka as the “DRIVER” of the vehicle they arrived in)

To enter store, you must be ‘buzzed in’..
Once inside, an argument ensued about grillz, payment already received for said grillz and no delivery, and from here it goes downhill. Allegedly, one of the 2 inside pulled a handgun - owner fired back - party outside tried to get in - owner may think he is armed, coming to assist - driver hits the gas and is long gone...

Typical night in North Omaha...

It's a good thing the store wasn't in New Jersey. The bayonet lug makes the SKS an assault rifle here. Can't have anyone defending their lives with an illegal weapon...even if it's an old Russkie semi-auto.

Hmmm... If that was an SKS, it was either modified or he reloaded.

I’m glad I don’t have to investigate this one. I’m somewhat surprised anybody saw anything. Whenever I came up on something like a shooting in a bar, fifty people were in a one stall bathroom and nobody saw or heard anything.
