Stern Sues Lawyer

The legal melee sparked by the death of the late American celebrity Anna Nicole Smith continues to sprout tentacles: the lawsuit filed by Ms. Smiths lawyer Howard K. Stern against John OQuinn lawyer for Ms. Smiths mother proves even the lawyers are not above the fray.....
The weekend has come and gone without word of a custody agreement being struck between Larry Birkhead (the father of Ms. Smiths baby) and Mrs. Arthur.
The two were to have met over the weekend, without lawyers and away from the glare of the media, to try and hash out a custody arrangement. Ms. Smith had named Mr. Stern as the childs father, but DNA evidence has proven Mr. Birkhead to be the father.
Mr. Stern has said he wont fight Mr. Birkhead over custody, but also that hell work to ensure that Mr. Birkhead gets sole custody of the child. In fact, he said on Friday that he would have already signed the formal order granting Mr. Birkhead full custody of Dannielynn, but lawyers for Mr. Birkhead and Mrs. Arthur asked the court for a continuance without that order being signed.
While she was alive, Ms. Smith vowed repeatedly that her mother, Mrs. Arthur, would have no part in her daughters life. The sides are to meet in the Supreme Court again on Friday.

Lawyer Says Paternity May End House Battle

Larry Birkheads confirmation as the father of Anna Nicole Smiths infant daughter Dannielynn paves the way for an end to the legal standoff centred on the Eastern Road mansion called Horizons, according to the lawyer for one claimant to the houses title.
Godfrey Pro Pinder told the Journal that his client, Ms. Smiths ex-lover G. Ben Thompson, would "work with" Mr. Birkhead.
He has been locked in a dispute with lawyers for Howard K. Stern, Ms. Smiths live-in lawyer, over who owns the residence where Ms. Smith and Mr. Stern lived with Dannielynn until Ms. Smiths sudden death in February.
Mr. Stern and Dannielynn still live at Horizons.
Mr. Thompson claims he owns the home, since Ms. Smith never fulfilled the terms under which he supposedly turned it over to her, and Mr. Stern and lawyers for Ms. Smiths estate support Ms. Smiths claim the house was a gift.
Mr. Pinder said that the substantiation of Mr. Birkheads paternity claim adds a new dimension to the wrangling over the house.
"I believe that he (Mr. Birkhead) would also get temporary custody. If he gets temporary custody then he should replace Howard K. Stern in the house. You dont need to have two fathers in the house," Mr. Pinder said.
"We shall invite Howard out of the house, and leave Larry in. Well work with Larry. Larry knows who the owner is; hell eventually probably do the right thing and turn it back over to us."
