I think you have to take a deeper look at what Stern was stipulating and not be taken in by the way the media is delivering his "gracious offer of custody".

There are two things here that Stern wants:
1. Virgie having no legal say in anything; and
2. Stern maintains control of Anna Nicole Smith's estate.

An agreement for #2 would bypass the will, where when the will is declared invalid (and I believe it will be), his agreement with Birkhead will stand.

With that in mind, what do you think now?
