KB: We’ll get there. Can you tell me why it is that you had a commitment ceremony with Anna?
HKS: Anna told me that she could not stand, she could not do it, she could not put her son in the ground….
Seidlin: Put her what?
HKS: Put her son Daniel, to rest, unless we were together. She felt like she didn’t have family, she couldn’t do it alone, and Daniel was really who she thought was her only family.
Seidlin: Did this minister….did you exchange wedding vows?
HKS: Absolutely, we got married.
Seidlin: You got married on this boat?
HKS: Under God, absolutely.
Seidlin: And did you file a marriage the certificate of marriage with the uh clerk? HKS: No, we didn’t do it legally, under the laws of the Bahamas, because one of my former attorneys….actually with that firm Callenders and Company
JO: Your Honor, this is one of my former attorneys….
Seidlin: Well, we’re going, we are far afield, Texas.
JO: I think, way too far.
Seidlin: But let’s see what….but I’m doing a good job for you, aren’t I? I’m asking some of the questions, you’re going to ask on cross?
JO: Help me.

HKS: He was uh….

HKS: Well the marital privilege because of Daniel’s death, and I was wrongfully…wrongly advised that it applied to things prior to marriage, not just acts subsequent to marriage.
Seidlin: You missed me, I’m just missing this. Run this by me again. I mean, I had a light lunch, so I’m still strong. Tell me.
HKS: [Shakes head, takes time by taking a drink] Anna wanted our marriage to be a legal marriage. I had some concerns, because I was concerned about how people would perceive it. I was concerned that people would think that I’m making a run for her money. But what finally convinced us not to make it legal, was upon the advise of counsel that the marital privilege…
JO: Your honor, I object to advise of counsel.

Seidlin: You have a continuing…..my friend, Texas, you’ve got to have to sit down for a long while now. Allright.?
JO: Do you want to hear it?

HKS: Because her son had just passed away, and we didn’t want to give any perception that we were trying to hide any wrongdoing.

Is he talking about a spouse having the right to NOT testify against their spouse? Is he implying that Anna wanted to marry him so he wouldn't testify against HER?
