True, but it wouldn't stop Birkhead from proceeding by himself to prove it is his daughter he is fighting for... just for his own peace of mind.
Birkhead has probably already done this on his own but still it would never hold up in a court. (The Thompsons could have easily got something with the baby's DNA on it to give to Birkhead.)
