I don't see it that way at all. If ANS and HKS were married there would be no issue. If someone else was not saying they were fathers of the baby, there might not be much of an issue, but in this case it is so muddied, if I was the judge I'd rule to give the body to Virgie...

but since Stern is fighting so hard for the body (how much has ET offered to pay him to cover the funeral?) the judge is rightly concerned about what makes Stern think he has any right to her body... and since Stern is saying his right is as father of Dannielynn the paternity comes into issue.

That's exactly the point. Stern and anna were not legally married to the best of my knowledge.
That makes her mother next of kin (which means the body should be turned over to the mother)

There is no other issue that this judge was supposed to involve himself with.
Paternity of the baby has nothing to do with who gets the body.
