Judge Orders Birkhead Paternity Test Completed By February 21st, 2007 or Anna Nicole Smith Travels To Los Angeles

According to Larry Birkhead attorney Debra Opri , Los Angeles Superior Court Judge Robert A. Schnider ruled today that Anna Nicole Smith and baby Dannielynn must submit to DNA paternity testing without further delay or excuses in the Larry Birkhead paternity case.

The judge will not tolerate any further delays or excuses and the test must be completed by Wednesday, February 21st, 2007. The judge indicated the test may take place in the Bahamas without technicalities or she can call her travel agent and take the test in Miami. If the test is not completed by February 21st, the judge will order Anna Nicole Smith to Los Angeles to appear before him in Department 2 of the Los Angeles Superior Court.

Judge Schnider further indicated that her continual refusal to follow his orders could result in severe consequences

STATEMENT MADE TODAY BY BIRKHEAD ATTORNEY DEBRA OPRI OUTSIDE LOS ANGELES SUPERIOR COURTHOUSE

Statement by Larry Birkhead's Attorney Debra Opri at press conference on Thursday, October 26th outside the Los Angeles Superior Court:

"Good afternoon.

"On October 11th, this office first learned of the existence of a Bahamian birth certificate bearing the name of Howard K. Stern as the father of Dannielynn. This office immediately began inquiries and investigation into the veracity of the document and learned that as part of the application process to secure such a birth certificate, affidavits had to be prepared under penalty of perjury by the parties. Based upon the results and findings of this investigation, my client Mr. Birkhead has instructed my office to secure Bahamian counsel to file an immediate action for fraud and conspiracy based upon both Anna Nicole Smith's and Howard Stern having filed fraudulent documents with the Bahamian government. This action also involves the Registrar General and it will be up to this governmental entity to pursue any criminal investigations.

"I am proud to announce the law firm of Alexiou, Knowles and Co. has accepted this assignment. They are noble, ethical attorneys with a stellar reputation.

"As you are no doubt aware from recent developments in the Bahamas, as concerns the issue of Ms. Smith's residency, I do not think that anyone should be shocked or surprised by these recent developments.

"As we speak Anna, service of this complaint is now underway. Upon service both Ms. Smith and Mr. Stern will have 14 days to appear in person to respond to these allegations. As you can imagine, the walls are closing in.

"In addition to this filing my office has also instructed our Bahamian counsel to secure injunctive relief which will prevent Mr. Stern from holding himself out as the father of Dannielynn.

"Regarding Mr. Birkhead's paternity action here in Los Angeles, as you know, today was to be the hearing on our request for a paternity test, as well as the court's decision on Anna's challenge with the California jurisdiction. There is now a new judge that has taken over the handling of our Los Angeles paternity case. Accordingly, all matters that would have been heard today, will be the subject of a calendar conference on Monday, October 30, 2006 at 1:30 p.m... This is common and it is not out of the ordinary.

"Finally, and most importantly, because of the events that have recently and quickly transpired in the Bahamas concerning Anna's residency and property ownership issues, ongoing perjury and fraud allegations, and what we have learned may quickly become a full fledged government investigation of Anna Nicole Smith's and Howard K. Stern's actions; because of continuing rumors that she may either flee the jurisdiction or be deported, and because of reports of recommendations for an inquest concerning the death of her son due to drug issues, for which you are all aware, my office is now cooperating fully with authorities concerning what we consider a serious and potential flight risk.

"As you know, my main concern is the child. We do not want to wake up one morning and hear that she fled the Bahamas to destinations unknown.

"And while I do not anticipate that Anna Nicole Smith will be going to Disneyland here in California anytime soon, I do have every concern that she may be go to another jurisdiction with my client's child in which we will again be forced to pursue her."
