You're kidding??!! I'm not talking about the investigation of her death; I'm talking about the illegal drugs. How can there not be a criminal investigation when illegal drugs are found?

It just said it's not a criminal investigation.
Now, I think what that means is: they're taking it on face value right now that ANS suffocated on her own vomit. Nobody can make that happen to you directly, without pushing your face in it - and she may not have been found face down. (That's just an example - lots of other possibilities.)
After the autopsy, then they'll have to state a Cause of Death. At that point, we'll know if they're going to call the "manner of death" natural causes, homicide, suicide, or unknown, as to the whether the drugs caused the death.
If she had thrown up the drugs, then there may not have been enough of them in her system to cause her death. Beyond that, then they would have to get into where the drugs came from and why they were there.
Maybe the best we can hope is that it's "unknown" and there will be a coroner's inquest, which isn't a criminal investigation, unless homicide is listed, but is conducted a lot like one.
Stern isn't even an eyewitness, as such, because he wasn't in the room when it happened (how conveeennnient) - but he is still a material witness as to the why's and wherefore's of how Anna Nicole came to be found dead in *that room*.
