He was going 80 in a 25 zone. Yes, it was his fault. Even if she was up to speed (25 mph), he would be closing at 65 mph.

Boren accelerated with an open throttle from an intersection near the crash site. Dennison said his estimate of 80 mph at the time of impact was conservative. Boren possibly was exceeding 100 mph.

I'm thinking you lost your marbles in an accident. If the bike was going the speed limit, she would no doubt have had plenty of time to cross the lane. But a small bike going at that great of speed would be asking for trouble. I understand defensive driving and the importance of watching for motorcycles, but this is completely the bikers fault.

Any accident that involves a vehicle doing 80 in a 25 is at least partially the fault of the guy doing 80.

Ask any rich personal injury lawyer who specializes in car accidents.

If he was going 80 in a 20 zone, yes. And I say that as a rider - when someone pulls out in front of me when I'm going faster than the posted limit, I assume that they probably looked and didn't see me, or saw me and judged from the distance that they were safe to pull out, based on the speed they assumed I would be going.
