Under normal circumstances, the exculpatory evidence would have been considered but, more than that, the determination as to whether or not there had even been a crime would have been examined. NEITHER happened in this case.
I wonder how unusual it is for an indictment to be brought down without ever having SPOKEN to ANY of the accused.
You are correct as to the facts of this case. My comment was about the life changing effects for the subject of any false rape accusation. I think we can all agree that the Duke case is an aberration of the CJS.
