Cab driver in lacrosse case acquitted (DukeLax cabbie escapes Nifongery)

The Durham cab driver who has surfaced as an alibi witness in the Duke lacrosse rape case today was found not guilty of a 3-year-old shoplifting charge.

Moezeldin Elmostafa is expected to provide an alibi for Reade Seligmann, one of three Duke lacrosse players indicted in the rape case, because he gave Seligmann a ride after the party that led to the rape allegations.

After authorities learned of Elmostafa's potential role in the rape case, they found an unserved warrant naming him in a 2003 shoplifting case at a Hecht’s department store at Northgate Mall in Durham. A security officer for the store testified today in district court that he saw a woman steal handbags from the store and then jump into Elmostafa’s cab, which sped away.

The security officer testified that the cab pulled away even before the woman had closed to the door. A store surveillance tape, played in court, appeared to show that the door closed first.

Defense lawyers in the lacrosse rape case have said that Elmostafa was charged because he is a favorable witness to the defense. Loflin put one of the lacrosse investigators on the witness stand this morning and produced typed notes from the lacrosse case that show District Attorney Mike Nifong wanted to be informed when Elmostafa was arrested.

Assistant District Attorney Ashley Cannon told the judge the shoplifting case has nothing to do with the rape case.

I looked at voter registrations in Durham and the only Terry Mangum registered is Black/African American.

I saw that too. There is a Joseph Terry Mangum who is white. Not sure if he is the Mangum of FOP. The FOP Mangum is a retired Durham police officer. The picture/article I linked to Mike shows a white police officer. Maybe there are/were two Terry Mangums with DPD?

Also, white Mangum registered to vote 1971 - Republican (retirement age of FOP Mangum?), black Mangum registered to vote 1991 - Democrat.

When I read Ruth piece is confirmed what I suspected from an e-mail she had sent me earlier disagreeing with me. She's reading the blogs - and I suspect she's reading FR.

Yeah, she had that piece, but her article confirms what I got from the Jail - she didn't think to check on the location of the serial criminal 126/Hawkins without reading that. She noted the use of ELMO which wasn't happening when she made her blog article 3 weeks ago or so.

IMO, the reporters are reading the blogs daily - and that's why you had reporters from 3 stations and 2 newpapers asking
Wilson about the detectives in the courtroom. The last time Elmo's case was postponed there was no media there. They didn't know the name of the Judge, etc.

In the intervening period from his last scheduled trial to Tuesday a lot has changed, IMO. The forums have proved right point after point in this case.

Her behavior in the weeks after the incident - hiding, odd behavior, screaming fits, well... if you've ever seen some "detoxing" it can be like that. I watched someone detox from alcohol, she was hiding a drinking problem that included at least a couple of liters of wine a day, and then stopped suddenly without telling anyone - and within a couple of days I had to take her screaming to the hospital.

Anyway, when I heard the FAs behavior I thought - "that's it!"

Nifong probably meant it didn't show any illegal controlled substances. It probably showed too much flexiril.

The hair test won't show alcohol, so we'd need the blood test results for that I guess.

I was thinking that she might take extra flexiril to "get ready" for a show, and this bump in the dose would stand out in the hair test.

Yes, you have to be very careful trying to understand Nifongese reported by an unterNifong in Nifongland.

I looked out of the window about an hour ago and saw 5 cop cars sitting in front of my house.

"Paranoia atrikes deep" LOL even though I knew there was no way in hell they were coming to my house, it still scared the bejesus out of me.

I thought maybe they were gathering for a bust in the neighborhood. They sat there for about 15 minutes and then 2 pulled off.

Turns out there was a domestic disturbance next door. Fire truck and rescue came but left with no passengers.

They escorted the husband to his car and he left. Then I heard a siren close by, must have picked him up there.

Anyway, to make a long story short, even though we are talking about a corrupt system in Durham with corrupt officers, I am reminded that the large majority of LEO are good people who put their lives on the line to keep us safe.

Just wanted to say that.

Yep, until defense gets an actual test, we will not know what Nifong meant by "no controlled substances were found".
Substances controlled by whom?
And what does "found" mean?

Maybe disinformation in it, which is useful to those who know about the case and want to anticipate Nifong's strategy. But she was recommending it to people unprepared and lacking the knowledge about the case. So they would more likely be snowed by the article and believe Gottlie's report gave Nifong a reason to go on rather than was manufactured to plug holes in Nifong's case.

Her Father has her driving her car after getting released from the hospital. I didn't look back and see if her driving status was sorted out yet; However, if she can drive - then the 2 drivers are because of a drug or alcohol habit.

1) We know she has at least one working car
2) The Drivers' own statements have them dropping her off and picking her up. They don't hang around at all! So, it can't be for protection.
3) Either the NYT or Neff stated that she had a history of visiting UNC for CHRONIC Neck and back pain. Chronic indicating a continuing condition. Some may say 27 is a little young for chronic neck and back pain.

She may not only using prescription drugs and alcohol to get up for dancing, she may need them to function.

Kevin Miller, with sources in the DPD and Defense teams, said on TV that his information was that she had been admitted or committed into some type of facility for mental health reasons. This could have been a rehab center. Sometimes mental health facilities are co-located.

In the absence of street drugs, prescription drugs mixed with alcohol are frequently substituted.

Back to the Car, why the need to get her car right away after being released? And where was her car? Was she storing something in her car or trunk that she didn't want exposed knowing that she had a record and she was going to be having contact with the Police?
