The Durham cab driver who has surfaced as an alibi witness in the Duke lacrosse rape case today was found not guilty of a 3-year-old shoplifting charge.
Moezeldin Elmostafa is expected to provide an alibi for Reade Seligmann, one of three Duke lacrosse players indicted in the rape case, because he gave Seligmann a ride after the party that led to the rape allegations.
After authorities learned of Elmostafa's potential role in the rape case, they found an unserved warrant naming him in a 2003 shoplifting case at a Hechts department store at Northgate Mall in Durham. A security officer for the store testified today in district court that he saw a woman steal handbags from the store and then jump into Elmostafas cab, which sped away.
The security officer testified that the cab pulled away even before the woman had closed to the door. A store surveillance tape, played in court, appeared to show that the door closed first.
Defense lawyers in the lacrosse rape case have said that Elmostafa was charged because he is a favorable witness to the defense. Loflin put one of the lacrosse investigators on the witness stand this morning and produced typed notes from the lacrosse case that show District Attorney Mike Nifong wanted to be informed when Elmostafa was arrested.
Assistant District Attorney Ashley Cannon told the judge the shoplifting case has nothing to do with the rape case.

Hey, for me this was the money quote in Ruth's article :
"There are some charges that, for the sake of the accused, the victim, and the community, it just might be better to drop."
I was looking at the AV's accident report dated 5/02/05. She was ticketed for failing to stop at a red light.
Wasn't she on probation? Surpising with her record she still has a license, to say the least.
Not bad, but there isn't a victim. There is victims and none of them are female. But it is good to see that she realizes what this will do to Durham.
Congrats to Moezeldin Elmostafa
BINGO!

Somebody Jackson, but can't remember which one.
Does she STILL have a license?
Actually, that's problematic for her too. Why does she need two drivers if she has a license? Is it so she can use?
Courtesy of her father, we know she had a running car at the time.
Even though it's long over-due and a six year old could've figured it out - I'm surprised Ruth has made this concession.
That's a testimony to just how little evidence Nifong has.
Remember, the N&O has the Discovery Documents.

I may be jumping the gun, but fellow helicopter pilots: We may have a convert!
Even if Elmo were guilty -- and he might have been -- the district attorney's office should have taken a hard look at the evidence. From the vaunted videotape, to the testimony of their star witness -- a habitual shoplifter with a record a mile long.
In fact, "Elmo hour" might hold a pointed lesson for Nifong et al: There are some charges that, for the sake of the accused, the victim, and the community, it just might be better to drop.
Drop the charges? I'm speechless! God Bless You All!
The hair test would have found GHB.

A controlled human administration of 25 mg/kg to a volunteer demonstrated that a single exposure to GHB is detectable in hair after segmentation. In a case of rape under influence, a clear increase of the corresponding segment (about 2.4 ng/mg) in time was observed, in comparison with the other segments (0.6 to 0.8 ng/mg). This study demonstrates that a single exposure to GHB in a case of sexual assault can be documented by hair analysis when collected about one month after the crime.
Good question! I resigned my job as secretary of a church in town after some jealous people (including the pastors wife) railroaded a youth minister and he "resigned" (even though he had no other church to go to) I got up and read a statement to the people there at the meeting. I knew it was coming for a while and had time to prepare a statement. BTW, the youth minister's wife has a beautiful voice and that didn't sit well with the pastors wife who was the "star" of the church.
See what happens when I rely on my memory????
Thanks for the list.
Thank you!

Ruth is linking to CTV boards! Now I see where she gets "black-helicopter-infested," "paranoid" and "hysterical."

See prior. THAT'S what I was looking for and could not find. GHB does not wash out of hair. Thanks.
I think that's right. One of my summer jobs involved doing research for a "think tank". Because the think tank did work for the federal government including the Defense Department, I had to go through a security check to get into the building and work there. This involved a background check and filling out every form ever created.
It also involved pulling out some of my hair for a drug test. The person who took the hair sample told me that they were looking to see if I had used anything over the past few months. They weren't concerned about the last week or the night before because they figured I knew I'd be drug tested and would have stopped using. But they told me if I had used anything over the past few months they would find it.
Her hair had so much drug information in it that it would have been impossible to trace to a specific date.
Well, the PC double standard lets the pot-bangers choose which acts are bad, and which we should ignore.
Let's sum up the Duke case - the boys drank, hire a stripper, and when they were ripped off, used the N-word.
So destroying them is OK - they probably had it coming the pot-bangers figure.
But wasn't there a woman's team that hired some male strippers for a party? Wasn't the penalty just a suspension, or something? And the N-word - it's OK if the BALD cop says it - because he is trying to railroad these guys. It's like the double standard the pot-bangers had with Clinton.
And why hasn't the N&O thoroughly investigated the Blinco's incident? Because they are pot-bangers too. They don't think it's a big deal if their guy - a COP does it. It's only bad if a white male "privileged" college students does it. And if he does they are happy to "go berserk" and destroy every white male with in reach
