Duke lacrosse files show gaps in DA's case (DukeLax - NandO FINALLY tells the story)

DURHAM - Investigator Michelle Soucie of the Durham Police Department was working the phones the afternoon of April 17, trying to set up DNA tests on evidence in the Duke lacrosse case. A private laboratory in Burlington gave a price, and Soucie immediately contacted District Attorney Mike Nifong.

In examining the files Nifong has produced in the case, The News & Observer found that the accuser gave at least five different versions of the alleged assault to different police and medical interviewers and made shaky identifications of suspects. To get warrants, police made statements that weren't supported by information in their files.

Much of the district attorney's evidence is contained in more than 1,800 pages of documents he has made available to the defense under a recent state law requiring prosecutors to open their files before trial. Those documents are only part of the evidence that could be introduced in a criminal trial. They do not include information still being gathered or testimony that might occur under oath.

But they offer the most complete picture thus far of evidence in the case that has put Durham and Duke in the national spotlight. The documents -- police notes, court orders, DNA tests, interviews and handwritten statements -- show what the prosecution has learned and how it conducted itself in State of North Carolina vs. Collin Finnerty, Reade W. Seligmann and David Forker Evans, who could face decades in prison if convicted.

If she reads the N & O story, maybe she'll get to work on her cover story about corruption in Durham, manipulation by a crooked DA and police force and judges, and join in calling for a federal investigation of the whole mess.

She can call it, "To Kill A Mockingbird, 21st century style".

(Newsweek OWES the players at least one cover story, if not more.)

TD-sometimes I just forget things. What happened in March, April and May seems like a lifetime ago. The trip to UNC just vanished from my memory.

I wonder if she went tried to get pain meds from Duke that night and was denied which is why she went to UNC. It would be very revealing to see her discharge papers. What meds, if any, was she discharged on? Advils? Anything stronger?

If I was her Nurse and if (speculating only) she was aking for pain meds far and beyond what her pain level should be (ie faking, and we are generally a good judge) I would document each time she asked for pain meds, my notification of the MD, and his response. Something like:

c/o pain in such & such area. Rates a whatever on scale from 1-10. Dr aware. [Next line would be an order from the doctor if he ordered anything]

I would also document a request(s) for a prescription prior to discharge. If she was unhappy with what the doctor prescribed, I would also document that.

I'd love to read her charts at Duke and UNC.

Walking around with ONE four inch platform shoe could throw your leg out of whack, but papa didn't know that, did he?

As for "AV Never forgetting those faces," wonder why she could not identify them in several line ups.

As for the trip to UNC the next day, it is only my guess that when she realized that she had lost her purse (with Flexoral in it) she needed to get a new prescription. ie- neck pain.

Sciatica would explain the leg/hip pain. Sounds resonable, she may have needed a Flexeril refill. Without medical insurance or a regular doctor, the trip to UNC Emergency could be the routine.

(To explain supposed eye and cheek bruising, it's possible that the pimp/boyfriend also knocked her around. Which "boyfriend" drove her home?)

If it is true and she was googling lacrosse players, you're right, it's hugh and series. "I'm going to take a shower, let me know if something big happens." LOL

or Flexiril - presents with a sprain neck - and then she offers, (I'm guessing) Flexiril is what they gave me last time and it worked.

The N&O said her main complaint was Neck Pain.

Flexiril and Liquor may have been her thing at that time.

I agree- these two seem to be her "drugs" of choice. I doubt she legitimately "needed" Flexiril for "pain" but most certainly liked the drug. Neck pain will get me some Flexeril.

I would also like to know who drove her home from Duke Hopital and who drove her to UNC? And if Nifong is aware of any prescriptions that were given at UNC as he, iniitally at least, described the "strangulation" of AV maybe to justify her alleged neck pain. He may have been trying to justify the prescription so it would not be "confused" with the date rape drug theory that was floating around at the time.

Has the "boyfriend" been identified? Who drove to UNC Emergency? Has a timeline been established from the time she was released from Duke, seen at UNC Hospital and met with DPD investigators?

And she said at that house. And then I felt horrible, because that was the same place that she asked me how to get to.

GRACE: Sir, I just -- I hate what you are going through right now. When you spoke to her afterwards, did she talk to you about having to go through the whole examination, and talking to police, and so forth?

TRAVIS: Yes, she mentioned something about where she said she had -- the next day, she had to go to see or identify the people, I think it was, the way she put it.

GRACE: Could she identify any of them?

TRAVIS: I think she did.

She tells Police that one of her attackers, Matt, was getting married the next day.

She also tells UNC Hospital - that she was at a BACHELOR party - and that the other girls (plural) wanted her to stay.

She's TWICE to two different organizations - saying there were more than TWO girls there and she's claiming it was a Bachelor party.

I don't think she has A CLUE! I don't think she knows what city she was in. That would explain the Short FAT Lacrosse players (of which there are none)


The above takes us back to her 3 license suspensions - her strange behavior in 2002 when she stole the taxi - and her Mental Health confinements.

Her father is hardly a good source of any information. He tells Nancy the next day (presumably after the party) Precious had to go in and identify the people.
Obviously that's not true, as she didn't identify "the people" until April 4th.

I agree. I don't think she has a clue. She was under the impression she was performing for a bachelor party, apparently, so she came up with Matt getting married the next day. This lady is a wacky storyteller, and it's hard to believe anyone in their right mind would take any of these stories seriously. Of course Nifong presumably did, but then I question if he is in the right mind.

I think somebody is playing a joke. Defense attorneys were asking Nifong for her computer. Nifong, as usual, seemed to be unaware that DPD had her computer. Defense attorneys definitely did not confiscate her computer through a search warrant.

Read the entire thread. One poster makes the case that the defense is entitled to the computer AFTER the prosecution inspects it. This is plausible...

Yes, it's plausible. But the poster who claims to have had inside information had it really wrong from the beginning, claiming defense confiscated her computer through a search warrant.
Which can't be true, as they were asking Nifong for it.
Did Nifong ever give it to them? That's the question.
