Duke lacrosse files show gaps in DA's case (DukeLax - NandO FINALLY tells the story)

DURHAM - Investigator Michelle Soucie of the Durham Police Department was working the phones the afternoon of April 17, trying to set up DNA tests on evidence in the Duke lacrosse case. A private laboratory in Burlington gave a price, and Soucie immediately contacted District Attorney Mike Nifong.

In examining the files Nifong has produced in the case, The News & Observer found that the accuser gave at least five different versions of the alleged assault to different police and medical interviewers and made shaky identifications of suspects. To get warrants, police made statements that weren't supported by information in their files.

Much of the district attorney's evidence is contained in more than 1,800 pages of documents he has made available to the defense under a recent state law requiring prosecutors to open their files before trial. Those documents are only part of the evidence that could be introduced in a criminal trial. They do not include information still being gathered or testimony that might occur under oath.

But they offer the most complete picture thus far of evidence in the case that has put Durham and Duke in the national spotlight. The documents -- police notes, court orders, DNA tests, interviews and handwritten statements -- show what the prosecution has learned and how it conducted itself in State of North Carolina vs. Collin Finnerty, Reade W. Seligmann and David Forker Evans, who could face decades in prison if convicted.

It will put pressure on Nifong, and it may even get Titus's attention, although not likely enough to inspire him to shape up.

There are a few things I didn't know in there. Not only couldn't she pick anyone out of the previous line-ups but she said she was only 70% sure Reade was there. Then a few weeks later she ID's him with 100% certainty as one of the attackers.

Also Precious said Kim stole $2000 from her. She's got "Matt" at 270 pounds and getting married the next day.

In the search warrant affidavit Himan stated Kim said the players claimed they were on the Duke baseball and track teams but his own notes say Kim mentioned they were on the lacrosse team.

And on the day of the first two indictments, Nifong has the police trying to figure out if there were any other things that could have caused Precious' diffuse edema. But, I thought he believed her? *sarcasm*

Here's one other thing I didn't know - at Durham Access someone asked Precious if she had been raped and she said yes. She never volunteered that herself. I wonder if that planted the idea in her head?

None of this is new to NIFONG. He knew every bit of this in April. Like 7 days ago, he was speaking publicly on the issue and drawing attention to himself and the Duke case.
He spoke of the Durham Solution.

No doubt, this will prompt the Talking Heads to discuss, "How will Nifong get out of this?"

He's not trying to get out of this. He's trying to get convictions by focusing on the racial aspects and manipulating the jury.

He also enjoys being cast as the valiant protector of a "black girl" as Nifong called her when saying how he would not let this (gang-rape of a black girl) stand.

Yes, huge point. It's suggested to her first. It came out of someone else's mouth before it came out of hers.

I guarantee this will be a an issue at trial.

Yes, lol, I think "awakened" or "confessed" would have been more accurate verbs.

"Admitted" would be appropriate, too...

Yeah. That may be what did it. That explains all her numerous variations of the story. She was making it up on the fly and she was intoxicated or under the influence of something and she couldn't keep her story straight. Twenty guys, five guys, three guys, she was raped, she was groped, she was raped, Kim assisted, two dancers, four dancers, Kim stole her money.........

I'd be interested to know WHEN the NO got the info contained in the detectives' notes. Have they been sitting on this info all the while Nifong has been spreading his lies?
