I don't understand the Hammer and Greta acting like Abrams hadn't seen all the documents.

Networks use other networks for sources ALL the time.

It was disengenuous for Greta and Hammer to both say - Noone has seen the documents and one said, you haven't seen the documents.

They should have said another network has seen them and then characterize what MSNBC said. They have an obligation to their viewers.

And I agree, there are bad people in EVERY profession.

She was making things up that Nifong might have, except that we already know he can't have them just from what we can read online.

The problem is normally we'd all say - No. But, Nifong is so far out there, so detached, that we can't rule out anything at this point.

How does he come in and explain to the court that it wasn't in the Discovery documents?

Maybe we should have a discussion on that. There is going to be something missing. And we have statements from Nifong where he said - everything's in there. I turned it all over.

It's not going to be believable for him to say SBI reports came back so late, because he got this case pushed to front of the line for the entire state.

Yeah, I don't see why they didn't say anything about it either. I am also sure Sean could get a look at all of them if he wanted too. He could also disarm alot of pro Nifong people on his show when they say they the defense only leaks certain things and they want to see the whole file.

I said on the CourtTV site that some of the conditions for it ending on Thursday are in place.

1. It is the first setting for Evans and Finnerty and the second setting for Seligmann, but the judge is not requiring any of them to be in court. Not having them there when this is ended would be smart and prudent for safety sake.

2. There are motions before the judge that are really his call on whether he was sandbagged to order the DNA/photos used for some of the lineups. He could throw out the IDs and not let her ID in court and end the case that way.

3. It is summer so a minimal number of Duke students are around to be targets of race baiters the day or evenning this is dropped.

If this is going to happen, look for a big show of force in the courtroom and in the courthouse on Thursday. Either the judge himself could dismiss the case or he could throw out the ID and Nifong can act surprised and then annouce right after the hearing that he still believes Mangum but he has to drop the case. Thursday is a good day not to have a riot, the defendant are out of town, most other students are out of town. No one has yet filed against Nifong for the general election, so possibly this move could head that off.

This is an excellent opportunity to drop this case. The conditions are right. They might be marginally better at a hearing in July, but then maybe not if he can preempt someone running against him in the general election.

I'm sure the defense has thought of this but I was concerned that there is something buried in the evidence list that isn't what it seems.

He seems to think that his jury is going to win him the trial without evidence. I doubt he can call an all Black Panther jury. Even so he would lose it on appeal.

I'm also amused that he is distressed by the blogs. Tough sh*t buddy. Ask Dan how that goes.

She said the way the AV described it, there would have been DNA evidence. Filan says AV spit out DNA on the floor. Filan say in the way she described there would be DNA evidence, she says there is none.

That is what I am hoping he does. Stevens was clearly misled by Himan in his affidavits for the warrants he got. And the photo line up is clearly bogus and against all the rules they have for them in that state. I pray that Stevens shows some character and does the right thing here and starts ruling against Nifong.

Poor Finnerty is going to getting screwed in this DC brawl case. Judge Stevens needs to think about what Nifong's actions are going to do to him.

Is that what Gretta was talking about with this more legal troubles for a lacrosse player tease? I think he might well beat this charge too. They have talked very confidently about it and their is a reason the DA there offered diversion originally. The DC case must not have been a slam dunk or particularly awful or they would not have offered diversion.

agreed, it's definitely the time for dismissal. Conditons are right. National opinion is right. Prudent move by defense in timing of release of 1300 page discovery.

But, why do I have so many doubts? We'd have to see an entirely different Judge. Admittedly, a lot has happened since the last election.

BTW, I can't see that Repub - Monks causing any problems in Durham. He's not too TV friendly, and how many people make up their minds like that? He was looking down while they were asking him questions. He needs to call Kim's PR firm and get a personal Media trainer.

I agree. They use each others as sources all the time. MS-NBC has a slight advantage in legal matters because they have Abrams is an attorney. This is why I think they went with him and that FNC might be viewed by some as rightwing.

Yes that is what Greta was talking about. The DC was just a fight. He made a mistake and the DA in that case did the right thing and cut him a break. To go back on the deal when this case rape case is as weak as it is so wrong in my mind. They should just hold off till case is over.

My guess is that either the defense and/or Abrams will release the report to other news outlets-- possibly this week. They gave Abrams the scoop, but they also want this spread far and wide.

Stevens doesn't have to show character. All he has to do is realize where this is all going. If he has any brains he will do the right thing.

However, this is Durham. He may be owned.
