The motion also says the alleged victim told Durham police that she had performed for a couple at a Raleigh hotel hours before the Duke lacrosse party. She told police that she used a vibrator. Osborn suggests that could be the source of the vaginal injuries mentioned in the rape kit report. (snip) Osborn says the accuser gave conflicting accounts of what happened. The motion says medical records indicate she told a doctor that she used no alcohol or drugs. The accuser told the sexual assault nurse that she had consumed one drink of alcohol and was taking Flexeril, a prescription drug used to treat muscle spasms.
The alleged victim told a doctor the next day at UNC Hospitals that "she was drunk and had had a lot of alcohol that night," the motion said.
She later told police that she had consumed a 24-ounce bottle of beer and then told police she had two 22-ounce bottles of beer, according to the motion.

Abrams: Except that when Crystal came back out, she wanted to go back into the house and make more money. I can't believe I have to believe Yale Golanther on this case. This is insanity.

I still can't get over the fact thatin the highest profile case in Durham history (I imagine since it is the only one I have heard about), the Chief of Police has completely divorced himself from involvement and the District Attorney is apparently MIA.
It boggles my mind.
Abrams: Sexual assault nurse examiner noted only diffuse edema of the vaginal walls and contains no conclusions that the symptoms the accuser was raped.
Larry Koblinsky: We know from examination of the rape kit that she had intercourse with the boyfriend and prior gigs in which she used a vibrator and that could explain the edema. I hope the nurse was certified and had experience in this kind of testing.
Abrams: While invesitgator Himan alleges that accuser says she was hit, kicked and strangled, doctors found no neck, chest or vaginal tenderness. Accuser told nurse she wasn't choked and that no objects were used in the assault. All her body parts were normal although accuser says her body was tender.
Larry: Common when a woman claims she was raped; they get a medical history. IF there were signs of someone trying to strangle her, that would have been noted. The only thing of significance was a scratch on her knee and heel.

Abrams: Neither of the scratches were bleeding and both were obvious from the photographs I saw of her dancing so I don't think they're significant at all.
Larry: I like to think I'm unbiased, but other than DNA on the fingernal, and edema to the vaginal wall, all of which can be explained a number of ways, this is the weakest rape case I've ever seen.
Georgia: The complextion of the victim in this case is a dark skinned womana. Sometimes we can have a bruise and you can't really see if if we were fair people.
I can't figure out if the police chief has asked or has been asked to take a leave of absense.

Larry: That's wishful thinking. Professional use instruments like _____? When the record says there were no abrasions, we have to accept that...
Georgia: We don't have to accept that unless we find that particular instrument was used.
Yale: Nifong said this was a forcible rape and struggle and she has nothing on her body.
Abrams: Women can be violently assaulted and have no marks.
Yale: THe problem with that argument is she told the medical examiner that the boys didn't use condoms. So why no DNA.
Abrams: There's so many arguments in this case. But today, learning about Kim's statement:
"I went to my car wanting to leave but not wanting to leave her alone. SOme boys came to my window to talk. I was told she was passed out in back. I told them if they could get them to the car, I'd get rid of her. They brought her to me and I saw she didn't have her bag. She wanted to go into the house again to make more money."

Abrams: Based on the evidence that we've seen, it's time to drop this case. And Georgia, you aren't being objective. I believed Nifong when this case was first brought to my attention. But as the evidence comes out, I follow the evidence, not my prejudices.

There is so much new info, I gotta read stuff two or three times before I get it all.....
Abrams: Quiet. It's one piece of contradicted, inconsistent evidence. WHen I follow the evidence and everything in this case, EVERYTHING, goes against the DA.
