The motion also says the alleged victim told Durham police that she had performed for a couple at a Raleigh hotel hours before the Duke lacrosse party. She told police that she used a vibrator. Osborn suggests that could be the source of the vaginal injuries mentioned in the rape kit report. (snip) Osborn says the accuser gave conflicting accounts of what happened. The motion says medical records indicate she told a doctor that she used no alcohol or drugs. The accuser told the sexual assault nurse that she had consumed one drink of alcohol and was taking Flexeril, a prescription drug used to treat muscle spasms.
The alleged victim told a doctor the next day at UNC Hospitals that "she was drunk and had had a lot of alcohol that night," the motion said.
She later told police that she had consumed a 24-ounce bottle of beer and then told police she had two 22-ounce bottles of beer, according to the motion.

Bombshell: The second dancer, Kim Roberts, told an investigator that she heard the accuser was sexually assaulted and it's a crock and she was with her the whole time.
Arrived 11:30, changed into dance outfits. Given drinks and accuser's drink fell into sink. Accuser started showing signs of intoxication. Player brought out broomstick and players said they'd use it on the dancers. Dancers went into bathroom.
Kim and Crystal left but Crystal went back inside to make more money. Crystal did go back into the house and was there for 5 minutes alone when the rape could have occurred.
But the problem is that Crystal, when she returned to the car, told Kim she wanted to go BACK inside the house again to make more $$.
Abrams: Don't you agree that Kim is providing a story that doesn't help the DA at all?

Abrams: Why are they pursuing this case. All they have a lukewarm medical report with ambiguity, there's no evidence there was a rape at this house. Ever yother piece of evidence to come out has gone against the accuser. Isn't it time to drop the charges?
Pam: No. We have her identification and her fingernail in a trash can. (OMG - gag me -- these rape nazis are an embarrassment)
Abrams: Kim says that Crystal was acting crazy before they ever got in the car the first time, so the fact that she was crying later doesn't mean anything.
He has Pam Bondi on too. She is sniffing the Nifong glue as well.
Abrams: As a former federal prosecutor, can't you say it's time to throw up our hands and say this case is done.

Abrams: I have her written statement in my hands. Don't tell me about defense attorneys.
Abrams: No DNA.
Georgia: You can be completely consistent and still be wrong and I think these guys are wrong (?).
I don't think the inconsistent statements aren't a big deal and this doesn't hurt the prosecution at all.
Abrams: You don't believe that.
Abrams: This case has become an outrage.
She's been Nifongulated...
After Nifong's case finishes imploding, he ought to be disbarred.
Note that in Kim's handwritten statement, she knows the boys real names and the boys don't lie about what team they are from.
So what happened to trying to hide their identities?
She, in fact, did claim that she make his back feel better.
Abrams: What could be in the discovery we don't know about? What do we have? I've read almost all the discovery in this case. Every document being released could be a fraud and every document the defense is filing with the court could be a fraud. But lying about facts is a different story.
Yale: Everything the defense is filing is accompanied by police reports and directs the courts to an affadavit by either a witness or police officer. This case should never have been filed.
Abrams: We have new information about the physical examination of the accused. It doesn't help the prosecution. I don't get this case at all.
