The motion also says the alleged victim told Durham police that she had performed for a couple at a Raleigh hotel hours before the Duke lacrosse party. She told police that she used a vibrator. Osborn suggests that could be the source of the vaginal injuries mentioned in the rape kit report. (snip) Osborn says the accuser gave conflicting accounts of what happened. The motion says medical records indicate she told a doctor that she used no alcohol or drugs. The accuser told the sexual assault nurse that she had consumed one drink of alcohol and was taking Flexeril, a prescription drug used to treat muscle spasms.
The alleged victim told a doctor the next day at UNC Hospitals that "she was drunk and had had a lot of alcohol that night," the motion said.
She later told police that she had consumed a 24-ounce bottle of beer and then told police she had two 22-ounce bottles of beer, according to the motion.

1. I hope you are right.
2. It would be no more unusual behavior than refusing to view defense evidence. It is no more unusual than rigging photo arrays. It is not subborning perjury if he believes Mangum and thus Roberts [Pittman]. Prosecutors every day use carrots and sticks to change accomplices testimony.
3. He will keep the deal. He could care less about Roberts. He cares about himself and this case is about him.
Unless the defense pushes it, nothing will come of what Nifong has done because he is a dummyrat, so is the AG, so is the governor, and I would imagine a majority of the state bar is, also. Unless a judge steps in, or pssibly - maybe - the state bar, nothing's going to happen to him. I would be surprised if the defense is not contemplating a civil rights suit (to be filed in federal court) if there really is nothing else to Nifong's case because I think they already have enough to show a conspiracy to violate the rights of these boys. Further, the judge who signed the search warrants should have something to say about this. If it was Stephens, it'll be real interesting to see how he rules on this motion because it will tell us what side he's going to come down on should a motion for dismissal follow, which I think it will. If he's any kind of judge, he'll cut his ties to Nifong and grant the motion. At the very least, he should signal that NOTHING flowing from the search warrants can be used at trial.

That sums up what I'm thinking exactly! Just when I feared this topic might be drying up.
I forgot to add that the defense may have figured it out because of their early conversations with Kim. At that point, she was on the defense's side, and most certainly told the defense what all she had told DPD and Nifong. If that's the case, the defense would know those statements should have been in the 1330 pages of discovery. Their absence would have been a big clue. In any case, the defense is doing a good job of exposing Nifong's MALfeasance in this case by way of exposing DPD's malfeasance.
Two beers. Reminds me of a time when I stopped for an accident before the police arrived. Turned out it was a couple of drunk kids (I'd guess they were 18 or 19) who were just banged up a little.
Anyway, the cops arrived and one asks the driver how many beers he had. The kid says, "Two. No, a couple." Cop says, "Two. No, a couple, huh." I had to suppress a loud guffaw.
Nifong probably left all these scintilating details out of his original 1300 page evidence drop. Then he was compelled to turn them over. From what I've seen on FR before it's new for NC DAs to really turn over everything they have. He may have thought he could get away with it. That means there is a leak or a mole in the DPD (or I watch too much 24)or how would the defense have known there was this other exculpatory information? It also means that Nifong is a bigger scumbag than we had previously thought which doesn't seem possible. Federal Court here we come.
She went to Duke one night and Chapel Hill the next day? Weird.
But this brings up huge issues. If the information that was not turned over is mostly damaging to the state's case, and it sounds like it's the most damning stuff, the implications of a prosecutor hiding evidence, ignoring evidence, and doggedly persuing one person or group when his own witnesses are providing statements pointing towards another suspect (think of the $400.00) - this is big stuff.
This is major civil rights violations. I wouldn't be surprise if the Defense attorneys haven't already filed (or are in the process) of requesting the feds to take over this investigation and investigate Nifong. Think of the Cab driver in light of this revelation that Nifong's own witness (AV) fingered Kim in stealing in $400.00.
Think of the ramifications of Crystal (AV) saying that she hadn't had sex in the previous week to investigators when others have made statements that she had 5-10 sexual partners in the hours before the lacrosse party.
This is about as corrupt as it gets in 2006.

Did Kim know that she was charged with participating in the assault on Crystal? Because she's been very helpful to Crystal in her later statements.

It's coming out faster and faster. In the lastest docs, it says that Crystal says she hadn't had sex in a week.
Someone (I guess the drivers) gave testimony that she was humping more than a bunny rabbit in heat (my words).
