Attorneys in Duke rape case file motion to get lineup report

The woman who has accused three Duke University men's lacrosse players of raping her failed to identify at least one of them in a photo array eight days after the reported attack, according to a motion filed Friday by defense attorneys. The motion also says that she then selected him as an attacker more than two weeks later.

Or how many real victims don't get the searches, investigations, and prosecution they deserve because this FRAUD of a case is Durham's Priority number 1.

That is what get me mad. Rape is serious. It is up there with assault and right under murder. All the feminist out there are hurting their cause supporting this ho.

We grew up thinking that if someone who is innocent is accused, a committed judge, or prosecutor, or investigator would see to it that justice was done. They were supposed to be on the side of justice, not on the side of whoever claimed they were hurt.

It's a real shame that many of us no longer have faith in prosecutors and judges to do the right thing.

I've seen it happen to men I know. A girl gets mad because the director doesn't pick her for the lead in the play for her senior year, and she expected to get it. Then, she's suddenly involved in a whispering campaign, asking other girls if they don't think maybe he's been too friendly.

He gets placed on suspension, a new director comes in, and guess who gets the lead?

There are evil 17 year olds.

He was never fully vindicated, and it ruined his career.

There are two possibilities:

1. Nomination by petition.

The petition containing the signatures of approximately 6,500 registered voters. The candidate would not be a "Republican" or "Democrat". It actually looks like it is not a huge impediment as the name would appear in a grouping with Nifong as the Dem nominee. The diadvantage is that "straight line" voters would have to be educated to actually vote for an individual candidate AND that by voting straight line they do NOT preclude their individual vote for a Nifong opponent.

The statute does explicitly provide that even a voter marking a "straight party line" on a ballot will have their individual candidate choice counted from off the party line.

I think a legitimate candidate (not a "protest" candidate with minimal qualifications) would stand a very good chance of winning, in that 50,000 of the voters expected to vote in Novmber either voted in the democratic primary and voted against Nifong or didn't vote in the primary and likely would skew against Nifong in a general election, especially with all of the post-primary disclosures.

2. Write in

A candidate must register as a write-in candidate in advance of the election by filing a petition with 100 registered voters signatures. In all practical terms, it would be more difficult to win since not only would a candidate need to persuade a majority of voters, those voters would need to successfully cast write-in ballots, something most voters have never done before. There would be no "prompting" and the voter would have to write in such that "The voter's choice can be clearly determined." using the language in the statute. There would be a space marked "write-in" directly underneath Nifong's ballot position.

In neither case could the vote be for either of the two losing candidates in the May Democrat primary (including Freda Black)since North Carolina has a "sore loser" law.

I know. It's very unfortunate.

About 24 years ago, some former CIA guy was prosecuted in Houston in federal court, and sent away for a long time. I can't remember his name, but the initials JW come to mind.

Some time a few years ago, it turns out he was right all along, and the prosecutors literally framed him and knew it. That really caused me to have doubts, because I remember that trial.

In general, I dislike hyperbole, but I am noticing an alarming trend in the last 20 years. I can't put my finger on why. Back in the mid-1970's we knew a man in his 60's, married for over 30 years. His back-door neighbors' daughter used to come over as a tot, then as an adolescent and visit him when he was retired and puttering around the garage.

Of a sudden, she came up pregnant at 16. She told the police it was our friend. I was so shocked because I knew this man had done nothing of the sort. Turns out it was her Guidance Counselor at high school who fled the country when she finally spilled the beans. Our friend received an apology and the bill for his defense. It was a quirk to have something of this nature happen back then. Now? Well, I'll leave it to you young folks to figure out where the wrong turn was made.

It's Tracey Cline again. Yesterday I read about her going after Freida Black. I still can't find out if she was the one that was supposed to try Evan's noise violation and had it postponed because she couldn't be there.

Howard Williams, the jury foreman in that case should be applauded. I think Hannity or some other tv show should have Leon Brown and Howard Williams on their show so the world can see what BS goes on down there in Durham. Tracey Cline should be penniless and behind bars. And the judge who let this go on as long as it did should be tarred and feathered.

And let me guess, nothing happened to the prosecutors. They should have been jailed and all of the salary they earned during the time the guy was in jail should given to the victim of this frame up. And the judge should have been thrown off the bench.

hmmm....looking back at the search warrant affidavits, we can now see that the wording of them is at least a little shady, given what we know now.

The makeup bag, ID, and cell phone were not actually found in the house, but outside and brought in by the guys because CGM left them in the yard.

The fingernails were not found consistent with CGM's story, but were found in the trash can and turned over by the guys.

Why was a subpoena needed for the medical records and interviews conducted at the hospital?

OMG... Three of the lawyers that framed him became federal judges. And even when a judge did the right thing and threw out one of the cases he had to stay in prison a while longer because 3 jail house snitches said he was trying to put out a hit on the prosecutors. This mans life would make one hell of a book and movie.

So, what is most likely a black-on-black crime is not a priority to Durham PD or the city politicians. Six months and no pressure to complete the testing. Instead, the police raid the house and seize pot processing equipment. I guess their theory is that if they can make the victims look less than pure as the driven snow, nobody except their families are going to care if the case is never solved - lay down with dogs, and you're going to get fleas. But, all things considered, my guess is that if there was an inkling that the perps were white, DPD and the city's politicians and the black race-baiters and power brokers would be all over the case.

Oops. I stand corrected. Thanks, maggief, for posting that information. I had no idea we had a "sore loser" clause in the election code. Does that mean we can keep Al Gore off the ballots in the future?
