Attorneys in Duke rape case file motion to get lineup report

The woman who has accused three Duke University men's lacrosse players of raping her failed to identify at least one of them in a photo array eight days after the reported attack, according to a motion filed Friday by defense attorneys. The motion also says that she then selected him as an attacker more than two weeks later.

Why should a women who was raped be a zealot in falsely convicting a defendant in a nonrape? Does this somehow, in her mind, create justice for her own rape?

This is exactly the same as the race baiting groups wanting a conviction based on history. Does falsely convicting innocent white men somehow correct the injustice of the past?

Both completely lose credibility, and reveal their true agenda - revenge, when they want to talk about anything other than the facts of this specific case.

Anybody else see the Abrams show yesterday about the woman who was raped 20 years ago at UVA?

By the way. If there has been a silver lining in this case (albeit a very small one) it has been the emergence of Dan Abrams as a real go-to-guy in the matter of legal commentary. He has been the only reason I watch MSNBC. He is well-informed and tenacious in his questioning of guests. At the end of the show he answers viewer emails. Exchanges such as these are not uncommon:

Email: "Your attitude towards the victim nauseates me. What would you say if the victim were a white female?"

Abrams: "Oh, I would say drop the charges. I‘m not going to let the race baiters turn this into a race case."

Email: "Why not keep your nose out of the Duke case?"

Abrams: "Because I‘m the only one who is talking straight about the case."

Yes. You are right. Abrams is out in the lead.

However, since things got worse for the AV, I did word searches for Duke in the MSNBC transcripts.

Scarborough - 0 mins last week
Olberman - 0 mins last week
Tucker Carlson - 4-8 mins last week
Rita Cosby - 0 mins last week

Abrams must have some pull with that network. It's no coincidence that with the rest of the MSM, Rita and Scarborough abandon the story alltogether, and Carlson's time is reduced. Olberman only covered it when they were Racists foaming at the mouth. The network runs the shows and dictates the topics. I'm sure if Carlson could, he'd dedicate 30 minutes each night.

"Stephen A. Smith is a no-talent, loud-mouth hack who is single-handedly ruining ESPN. I can't stand that jerk!"

I agree. Nifong trumped up the case to make it what he needed - an opportunity for him to be a hero in Durham. It would give him Name recognition and erase the inherent doubts about him in the electorate due to his race.

I also found Tucker's subsidence of Duke coverage curious. I suppose it could have been his call, but I doubt it.

I wonder if the directive to tone it down came from the same network exec who suggested he remove his bow-tie?

I think there is increasing agreement amongst the rational punditry that there is no case here. If all the guests are going to agree to that then there is no show to be put on. In order to have any kind of debate at all, Abrams has been having to dip further and further into the cesspool of ideological moonbats. He's been having fun berating them about how stupid they are but most of the others won't do that.

Today's Herald Sun has an interesting article in which Assistant DA Tracey Cline seems to be caught lying to a judge about Freda Black. Cline also seems to share Nifong's disdain for expensive lawyers, and those who hire them.

What a nasty bunch of individuals they have in the DA's office. Here is what I find interesting in that article.

Assistant District Attorney Tracey Cline complained in court that Black had used a "million-dollar law firm" and gone "behind closed doors" to get the postponement.

So here we have her saying postponements are bad. Was it her or someone else in the DA's office that was suppose to try Evans on that noise charge and didn't show up for it and got it postponed?

That DA, Jim Hardin, is now one of the Superior Court judges who will preside over the Duke case.

This stinks. Just like how the last judge held Nifong's position before he became a judge and they still have lunches together.

Quite a contrast between Smith's article and the one written by Jason Whitlock early this month.

Justice is getting lost in Duke case

I've heard Mr. Whitlock on ESPN radio and apparently he's too soft spoken and thoughtful to merit as much airtime as Stephen A.

Second Lacrosse Party Dancer Makes Obscene Gesture In Court

DURHAM, N.C. -- A second exotic dancer who performed at a March 13 Duke University lacrosse team party where a woman says she was raped and assaulted by three athletes made an obscene gesture at a television camera during court proceedings on Tuesday.

When Kim Roberts noticed WRAL's camera in the courtroom, she made the gesture and then stuck out her tongue.

Roberts, 31, was in court for a probation hearing on a previous embezzlement charge. She was arrested on March 22 -- eight days after the lacrosse party -- on a probation violation from a 2001 conviction for embezzling $25,000 from a photo-finishing company in Durham where she was a payroll specialist, according to court documents.

In a previous interview, Roberts said she does not know if an attack actually happened, but said she has "to wonder about their character," referring to the suspects in the case.

"I was not in the bathroom when it happened, so I can't say a rape occurred -- and I never will," Roberts told The Associated Press in April.

Defense attorneys claim Roberts at first told a member of the defense team that she did not believe the accuser's allegations. They say she has changed her story to gain favorable treatment in a criminal case against her.

They note she also e-mailed a New York public relations firm, asking in her letter for advice on "how to spin this to my advantage." The firm later said it would not be representing Roberts.

Roberts' testimony could be vital during any trial of the three suspects, sophomores Reade Seligmann and Collin Finnerty and Duke graduate David Evans, who were indicted on charges of first-degree rape, sexual offense and kidnapping.

Roberts refused to talk with WRAL on Tuesday.

Is Nifong really going to walk into court with this crew of lit firecrackers? You know they will keep going off like this between now and any trial and then have the grand finale at the trial.
