DURHAM - A Durham grand jury is scheduled to meet today, and the session could mean new charges in the investigation of a reported rape at a Duke lacrosse team party.
Two of the team's players were indicted in April on charges of first degree rape, first degree sex offense and first degree kidnapping. They are accused of assaulting an escort service dancer in a bathroom of a house at 610 N. Buchanan Blvd. Their lawyers say the men are innocent, and lawyers representing dozens of team members say that no sex or assault occurred at the March 13 party.
But the woman says she was attacked by three men, and Durham District Attorney Mike Nifong said he has been working on bringing charges against a third person.
WHAT WILL HAPPEN TODAY? If Nifong decides to submit the case, police investigators and possibly other witnesses will try to convince grand jurors in a secret session that the state has probable cause to bring a case forward. Grand jurors will hear only the prosecution's side of the case. The standard required for a true bill of indictment is far lower than the beyond-a-reasonable-doubt standard required for a conviction.
IF INDICTMENTS ARE ISSUED, WHEN WILL THEY BECOME PUBLIC? On April 17, a judge ordered the indictments in the lacrosse case sealed. The names of the players who were indicted were not released until 5 a.m. the next day when the players surrendered at the Durham County jail. If Nifong again requests that the indictments be sealed, the law allows a judge to keep them secret until the person is arrested or appears in court.
WHEN WILL ALL THE EVIDENCE BE REVEALED? State law requires prosecutors to turn over all of their case files to defense lawyers, but nothing requires the evidence to be turned over to the public. In open court hearings, lawyers often discuss some of the evidence, but the state's case may not be revealed until trial. No trial dates have been set. When a report on the DNA testing is complete, Nifong is required by law to turn it over to all 46 members of the lacrosse team who submitted DNA samples.
WHAT HAPPENS NEXT? The cases against Reade William Seligmann, 20, of Essex Fells, N.J., and Collin Finnerty, 19, of Garden City, N.Y., are moving forward. Finnerty has a court date in June. Seligmann is scheduled to appear in court Thursday. His attorney, Kirk Osborn, has filed a series of motions challenging Nifong's handling of the case and asking a judge to bar the prosecutor from further involvement.

I've already acknowledged above in the thread to another long time poster (sorry its getting late and I can't remember who)I found it odd this is the second time she's claimed three guys have "raped" her.
I've never been a rape victim so I can't speak for other women, but I would hope that justice and truth always win out. And that other women, just because of one maybe false claim, would stop them from going forward themselves.
If anything, the hatred I've seen on theads and calling her things such as skank and whatnot would cause a woman to think twice about reporting rape, not this case.
I'm convinced that Nifong knows his constituency well, knows what they want, and what he thinks they deserve. And that is the satisfaction of seeing rich white boys be accused, arrested, wait many months for trial, and go through a trial.
That's what a thousand Durham men do each year, so why should these Duke guys have the process shortened just because there's no possible way they could be guilty? They shouldn't, and they won't with the heroic Mike Nifong now securely in charge for the next four years.
WOW! I didn't hear that! I think Nifong is not only going to lose this case but may have charges brought against him.
I still don't know why the defense didn't know of the "boyfriend" semen the first time DNA came back. I have been out of the loop, so forgive me if this issue has been resolved , and I haven't read the answer.
It certainly appears like the investigator was not anxious to follow up that ID.
Is a search warrant considered sworn testimony at this point? Is a ID considered sworn testimony at this point? Could be false reporting. But she hasn't raised her right hand and placed it on a bible and taken the stand yet and said those things has she?

What do you call a woman who has brought the city of Durham to damn near a race riot -- just because she didn't want to be arrested?

Do you know what my absolute biggest fear is -- that this girl will kill herself without this case ever being proven wrong.

My one hope is that Wendy Murphy, Lisa Bloom, and Nancy Grace and the rest of the Rape Nazis cut their tongues out this time.

The press told the defense attorneys they did.
Look back to late Wednesday and Thursday when all the articles said that there WAS a match; the defense team got it at 5 p.m. on Friday.
BTW, the lacrosse team at Duke does NOT permit facial hair.
She is lying about EVERYTHING.

Well I see it differently, I thought Duke had every right to kick the Black Panthers off their campus that day they did it.
I don't understand the "demand" for Wendy. I find her repellent, as in the mere sight of her catapults me into immediate action, which includes wrestling the remote out of my husband's hand and mindlessly pushing buttons to take me anywhere Wendy is not.
Going on the reasonable premise that stations like to keep people watching, others must not react to Wendy as violently as I do.

Then the point about facial hair on the team should have been something that Nifong considered before he felt he should pursue the case.
Believe me, their lives have been altered forever. Reade and Collin will never be able to walk down the street without people whispering. Imagine either of them trying to get a job?
Other team members are not welcome at schools they want to transfer to (they want out of Duke). This woman has caused a coach to lose his livelihood. I'm not even blaming the accuser anymore. She's a pathetic pawn in Nifong's game IMO

It tells me he's hell bent on prosecuting somebody for something.
