It's called probable cause.
Not a clear cut situation that the person DID the crime alleged. But the presence at the scene of the crime, opportunity and motive all gives rise that he is a suspect.
The DA is usually the one to make a determination of whether said person should be charged.
Rarely, but it does happen, the DA throws it against the wall to see what sticks. Obtain a plea bargain? Actually get a conviction. I was on a 3 strike jury with only circumstantial evidence provided. And the Defendant didn't plea like a good defendant should.
He walked. But the jury was 6-6 following the trial.
