Yes, that scenario is a very good possibility.

Unfortunately, not just the two guys but everyone at that party will have that cloud. People will think one of the other ones must be the "third rapist." Many people also will be convinced by Seligmann's alibi and think she just fingered the wrong guy, and one of the other guys must be the second rapist as well. That may even prove to be the case with Finnerty, if he turns out to have a strong alibi.
