Glad you're catching up (just kidding! :>) I think he is malicious, ora at least negligent and callous.

Yes, this ID wouldn't last five minutes here, and I don't think it will last in NC, either. I think this is why Nifong had people in with a search warrant searching Finnerty's dorm room and taking his computer. Nifong may have already thrown in the towel on Reade (in his own mind - not acted on it of course) but is hoping to get something more to hang onto Finnerty.

Let's say a witness saw a crime committed at a school by a bunch of students. I assume that it would be ok for the witness to look through a school yearbook to see if she could pick out anyone.

Is this different from this case?

I assume the difference is that in the above scenario that if the witness picked out anyone in the yearbook that she would also have to pick him out of a lineup. I don't think that happened in this case.
