Why indict anyone before the 2nd DNA test returns?

Grand Juries meet every two weeks. The next one is the day before the election. If he wanted to make arrests he had to do it with this past Monday's GJ. Unless he had the balls to simply make the arrests and then take it to the GJ later (which is the normal procedure). It's been obvious to me for weeks that he didn't have good IDs or there would have been an arrest long before this.
