"We are not in any position to safely "abuse" our power, however much or little we have. Jeb is."

I don't for one minute think he could defy the courts "safely". Law enforcement already stated they would follow the edict of the courts and not orders from the governor. Without the law to back him up what do think he would be able to do with Terri? Hide her in his garage? How long could they keep her before she was taken back to hospice and this process was begun again?

And even so, is that the criteria? Is everyone looking for someone to who can do this "safely" so we don't have to stick our own necks out and wind up in trouble over it? We each have our own reasons for not taking this past the legal limits. It's easy to blame others for not doing what you yourself are not willing to do. I don't think it accomplishes anything for us to eat our own and I believe that Terri Shiavo would not be undergoing death by starvation if Jeb Bush had the final say. He is not the enemy.

I'd like to know where all these nuts are at when voting is done, when laws are drafted, and when innocent people die every day. Probably home shining up their tin hats. Isn't it amazing how many people suddenly have a law degree, that have never (obviously) even read the constitution?

For all who think that pushing for a constitutional showdown would be the answer my question is what then.
Right now the dems are happy to stand on the side and watch the various circular firing squads form.If Gov.Bush had forced a showdown the dems would then be like a she bear defending her cubs. This would land in the US Supreme court in a matter of days.So you would have the judiciary deciding a case of reigning in the judiciary.
I wonder who would win that one.I can`t picture more than Rehnquist,Scalia and Thomas siding with the Gov.Got to protect the home turf you know.
This would ultimately strengthen the run away judiciary.
I wish I had an answer. The check on the Supreme court was to amend the Constitution. This was designed to be hard when there was only 13 states,it is virtually impossible now with 50.
