My disappointment in Hugh Hewitt (he criticized calls for Jeb to stand up to Greer and save Terri)

Hugh's been strong in defense of Terri -- till yesterday, when he devoted a lot of time denouncing those (like Dr. James Kennedy) who have called for Jeb to step forward - despite Judge Greer's injunctions - and take action to save Terri Schiavo from a judicially-decreed death.

Hugh was going on about the "rule of law" and quoting the old chestnut from "Man for All Seasons," about how if we tear down the laws to get at the devil, we have nothing to defend ourselves when he turns on us.

But Hugh doesn't get it: IT's the ACTIVIST JUDGES who've ALREADY TORN DOWN THE LAWS. For some politician to stand up to a lawless judiciary would be a stand FOR the "rule of law," not against it.

We have a crisis of governance in this country, with judges taking seizing tyrannical power. Tthey're able to act as tyrants only because elected officials won't stand up to them. IF THERE WAS EVER AN OCCASION THAT WOULD PROVIDE AN OPPORTUNITY TO TURN THE TIDE - FOR AN ELECTED OFFICIAL TO SAY "NUTS" TO A DICTATORIAL JUDICIARY - IT IS NOW, WHEN THE TINPOINT JUDGE GREER, A HICK COUNTY JUDGE SWOLLEN WITH ARROGANCE HAS ORDERED AN INNOCENT WOMAN KILLED SIMPLY BECAUSE SHE'S dISABLED.

There are constitutional and statutory provisions enough for Jeb to rely on, as chief executive authority of Florida, to act to save this woman.

Hugh Hewitt, with all his civics lecturing -- taking the issue away from the life or death realities of this crisis -- forgot to mention some important historical precedents: Lincoln refused to obey the Dredd Scott (pro slavery decision); Andrew JAckson scoffed at what he considered an illegal order of Chief Justice John Marshall; Thomas Jefferson affirmed that EACH BRANCH of government has an independent DUTY to interpret and UPHOLD the constitution;;; and DWIGHT EISENHOWER SENT TROOPS TO CLINTON'S ARKANSAS (clinton was a kidk, of course)., when local politicians AND LOCAL JUDGES WERE IMPOSING SEGREGATIONIST LAWS, DENYING BLACKS THEIR RIGHTS TO EQUAL PROTECTION - i.e TO GO TO UNIVERSITY.

The showdown with arrogant judiciary has to happen at some point: Destiny has asked Jeb to be the hero for free government, and to take a stand. Hugh Hewitt counsels passivity: Let's hope Jeb finds the counsels of conscience to be louder and more persuasive!

Terri is bleeding by the tongue. Jeb Bush, Hugh Hewitt and the rest of should say "NO MORE!" to Mr. Greer, the judicial mediocrity who has ordered that torture.

Many people are offended that Terri is being starved to death, as am I. Florida law really does allow this to be done to people. So this is not why Jeb would step in.

Whether or not the law has been correctly applied in Terri's case is why Jeb would step in, i.e. is Terri truly in a condition that qualifies her to be killed under Florida law.

Just because liberals ignore the law when it does not work for them, does not mean that we should.

Actually, they prefer to create new law from the bench.

OK. In your "perfect" universe, how do you deal with the instance where the ones who decide if a change is even permissible are the lawless themselves?
Or are you suggesting that the judiciary can do no wrong?

Lifetime tenure is a bitch. The cure is worse than the disease, as we are experiencing now.

Asking for "facts" on which to base either is mindless and pointless.

You dont need that speech for me --maybe for some of the yahoos around here. But the question is --and it is a real questionthat needs to be answered, is do judges have the final say as to what the law is, perhaps the executive could have his own say. Why 3 branches of govt? What does coequal mean?

It is inconceiveable in Hugh's universe for judges to be lawless. When they are, he goes catatonic.

If the imperial judiciary comes into the spotlight, that will be a bittersweet fruit of this tragedy. I also think there is a split here occuring in Freeper land that might be indicative of what is going on among conservatives across the country--a division between whigs and tories. Hugh is basically a royalist, a tory, someone who distrusts the "push" that has always been necessary to push forward English rights. If he had been alive during the Revolution, he would have attempted to thwart it, and would have wound up in England hoping for a pension after it was all over. The whigs are the 1/3 of Freepers, and the rest of the country's conservatives, who see this for what it is--a violation of law and an attack on representative government. When Hugh watches a federal judge refusing a de novo review, is he defending that as a "nation of laws?"

I repeat. His basic problem is cowardice. He is too afraid to confront the results of his own convictions.

They do right now because that is what has been allowed to happen. Right now we do NOT have 3 co-equal branches. Both the legislative and executive have given away their power for years and now, when we need it, we find out what has been done under our very noses.

Congress, both state and federal, have been chipping away at executive power, and the judicial has for years been chipping away at legislative. This is the result. Total shock that things don't work the way we expect them.

It's sort of like running your car for years without changing the oil and one day it just won't start. Yeah, it's a shock because you have to get to work, but you really should have expected it.

Terri is THE MIRROR IN WHICH WE ALL VIEW OUR OWN INHUMANITY TO MAN.
Secularists can't stand LOOKING AT THEMSELVES. I pray that GOD keeps Terri ALIVE as long as possible, so we ALL GET a GOOD, STRONG, ACCURATE, LOOK at our own sinfulness. That's bound to do GOOD, no matter what people's reactions are. ALSO, this whole event could push us along the road to epistemological self-consciousness where middle ground and inconsistencies are eliminated.
This is what is required of us as believers: namely to confront the world and offer the Gospel. Whether people repent and believe is not up to us. Some will believe and others will reject the Gospel of LIFE and become HARDENED in their rebellion against GOD.

We are a nation of laws as so are other countries so to help in the underground railroad was wrong? Those that help the Jews to escape the death camps were wrong? Those that defied the segregation laws were wrong? Those that liberated those from Sadem's torture chambers were wrong. Those that defied King George's laws were wrong? If we are to believe that not following the laws are wrong than we as a country would never had existed but instead been under the thumb of England.

Thank God our forefathers did not have a problem with defying the laws. LAWS, LAWS, LAWS, LAWS can never be broken. Take a hard look at some of these Islam counties and their laws....Folks, the death camps are coming unless we stop it.
