I don't know what you'll accept as proof, but given that the courts can declare laws unconstitutional, it seems that Congress does not have the "ultimate" say.

I would suggest Article 3, Section 2 of the Constitution for your reading pleasure. Actually, the whole document is suggested reading for freepers.

And I sir would advise you to read Article 1, Section 3, Clause 5 & 6. I suggest that the SOLE POWER OF IMPEACHMENT trumps Article 3 Section 2 as per your reply...
