The judge denied all of the dems motions for dismissal on various different grounds, so the case will go forward.
But... he declared that nomatter the result of the case, he does not have the power to order a new vote. All he can do is order that the office be vacated, and that there are already other rules in place to handle a vacant office.

Yeah, so the question is does the Lt. Gov take over then, and would he be in office until 2008, or can the legislature call for a special election to fill the office?
