Probably because they all approved illegal warrants to surveille her.

Why?

Were they all in the Epstein files? Had sexual relations with Hunter Biden? Were covert FBI or CIA agents?

Yeah, that’s strange.

You shouldn’t use a recusal unless you have a conflict of interest. No?

Even if you are admitting a conflict of interest or involvement, you’re not necessarily admitting guilt, but it isn’t a good look either.

Is it considered acceptable to recuse yourself if something is just a hot potato and you don’t want to handle it?

Nah, the Sixth Circuit will just assign it to a judge from one of the other eight districts in that Circuit. Most likely one from the Eastern District or Western District of Tennessee. If not, one from a federal court in Ohio, Michigan, or Kentucky,

There is no rule to mandate disclosure of the reason(s) for recusal?

I know Aleta Trauger’s a staunch Democrat, so in her case it’s good of her to step aside. I don’t know the other three.

Factor in that they all know it’s 90% certain that Blackburn’s the next governor of Tennessee. Other than folding during the 2020 Presidential election like most of them (we still need to know why) she has a sterling record.

That’s only one reason a firm might recuse.

The other reasons to recuse are if the firm believes there is significant legal, financial or reputational risk in taking the case.

I know this because even I’ve had to instruct my firm from taking on certain contracts because of perceived / verified risks - including where the client crosses one of these red lines:

1. Adjudicated fraudster - NOT “fit and proper”
2. Flat broke or bankrupt- CANNOT afford to pay
3. Client has such a bad reputation, taking them on would bring our firm into disrepute.

I reckon Sen. Marsha Blackburn’s suit has no chance of winning unless the court hearing it is corrupt beyond all belief.

One: she’s even naming the wrong defendant in respect to the complaint that no statute authorized his appointment. If she thinks he somehow unilaterally bestowed the job on himself without anybody ever noticing or signing it off, she needs new spectacles.

Two: she might be naming the right defendant as regards “unlawful subpoena of her cell phone toll records” but the “unlawful” element is ludicrously subjective. She is literally arguing, it’s gotta be unlawful because he wasn’t appointed in the first place - and her ENTIRE CASE is predicated on him NOT being able to prove that his appointment was authorized.

Three: even if you can impugn Jack Smith’s motives, the fact is he really did dot all his Is and crossed all his Ts at every step. (Smith even sought approval from DOJ’s Public Integrity Section (PIN) before issuing the subpoenas; and it was Jack Smith himself who terminated the investigation following the ruling that POTUS could not be investigated.)

Four: Smith can even pull a precedent from the last Trump administration (2017–2018 leak investigations. The DOJ subpoenaed Apple (and used nondisclosure/gag orders) for metadata, phone records, and related account data belonging to Adam Schiff and Eric Swalwell; the HIC; dozens of congressional staffers (both parties), and their family members (including at least one minor). The Inspector General later reviewed it and found no policy violation. Gag orders kept the targets in the dark for years.

Every reputable law firm in the state has taken a risk calculation based on the merits of the suit and the likelihood of Jack Smith saving them the hard work by ignoring a Matterhorn-sized mountain of defense angles at his disposal, to plead guilty to a charge that couldn’t be more easily beaten than suing Jack Smith because his pet Godzilla sunk Gomer Pyle’s battleship.

Bluntly, I’m not a lawyer and yet I can easily see two different ways that Smith can have this charge thrown out with prejudice without spending more than an hour in the courtroom; and I can see at least another five ways that he can dick around for three days without breaking a sweat, and still walk out of the court with the verdict in his favor.

And I can see multiple ways that Sen. Blackburn’s legal team will end up ordered to pay Smith’s costs. And I can see real problems even getting witnesses to back the plaintiff up - maybe some with Congressional or Senate immunity will risk testifying against him, but there’ll be plenty of people who don’t are considering it but thinking, “nope, I ain’t going down with THAT ship.”

So I reckon THOSE are the reasons why none of the “local” law firms are willing to represent Sen. Blackburn. She’s had to go to the NCLA in Virginia to find an outfit willing to take the risk.

Lawyers may be schysters, but good lawyers know how to cover their own asses.
