You can say anything you want about a dead person, outright lie about them, and it's not libel.

A cause of action must be filed before a person dies.
If Kirk had filed an action before dying, his estate would inherit the lawsuit, and it could go forward. But his estate can't file the action after his death.

It depends on the laws in the state it took place.
Death does not necessarily reset the clock if the slander/libel took place before death.
Can't you pretty much say anything about a political organization? Political speech is at the core of the First Amendment.
If you could sue for libel for political speech, there'd be thousands of lawsuits filed every day, millions by the end of the year.

Charlie was a human being, not a thing.
The vile stuff I’ve read were and heard were ad hominems directed at Kirk, not his org.
Untrue, defamatory, and said with malice.
The only question is whether or not slander/libel that occurred before death is actionable after death.
If it is, Deep State’s useful idiots may be about to find themselves left holding the bag.
What difference would that make? The effect of being slandered is just as bad for the widow as it would be for the deceased, should he still be alive.
I’d say Erika would have every right to protect the good name of Charlie.

Slander and libel law was written long before the internet.
Now we have the internet, and the internet can have a very long memory.
We may see some new law created because of this.
If so, let’s hope it will be both commonsensical and constitutional.
