How the system works for you and me —
Law Enforcement: “We have a reasonable suspicion that you have committed a crime. You are under arrest. You may be put in a jail cell. You may be required to post a bond. You will be appearing before a judge. You face a possible prison sentence.”
How it works for them —
Law Enforcement: “I’m not arresting any of these people. How do I know they’re guilty? I can’t arrest them if I don’t know for sure that they broke the law.”
That is correct. Of course the presumption of guilt has to be higher in some cases.. If you or I gets arrested and the case doesn’t hold up in court, we are simply acquitted with no fanfare. If a prosecutor loses a high profile case like this, there is usually a lot of political backlash, and civil action. Plus, the kind of people that are dealt with in these kinds of cases can usually afford the best attorneys in the country.
