I left the R party around 2003. I see the two parties as two wings of the same party. The R’s have an opportunity here to prove me wrong.

And Trump can promptly fire Boasbergs appointment the next day. Then he can assign the US Attorney for Lubbock Texas to take over the DC office.

US Attorneys are confirmed or not. But they are not confirmed only for one district. It would be easy to get around this unconstitutional challenge.

Does a federal judge really have the authority to appoint a member of the executive branch? That clearly seems counter to Article2 of the Constitution.

§541. United States attorneys
(a) The President shall appoint, by and with the advice and consent of the Senate, a United States attorney for each judicial district.< br> (b) Each United States attorney shall be appointed for a term of four years. On the expiration of his term, a United States attorney shall continue to perform the duties of his office until his successor is appointed and qualifies.
(c) Each United States attorney is subject to removal by the President.

Excuse me, where the F does it say JUDGE IN THE LAW.

If Cornyn votes no he may be toast in Texas! I know it is early yet, but Cornyn is down in the polls to Ken Paxton, the Texas Attorney General who will be running against Cornyn in the 2026 republican primary!

I've done a deeper dive on the Vacancies Act here with some conjecture;

I'm sure I'm missing something here, but under the Vacancies Act,
the first acting is good for 300 days. The next “acting” is good for 210 days...and I “think” he\she can be reappointed acting 1 more time...

so how does Boasberg even get his nose under the tent here...

The nomination of Ed Martin as U.S. Attorney for the District of Columbia is under threat as Senate Republicans face a May 20 deadline to confirm him or risk ceding the appointment to federal Judge James Boasberg, a development that has sparked concern among conservative lawmakers and activists.

Martin, who is currently serving as Acting U.S. Attorney for D.C., was nominated for the permanent position by President Donald Trump. His appointment has drawn fierce resistance from Senate Democrats and former January 6 prosecutors, who cite concerns over his ongoing inquiries into politically sensitive cases.

Martin has launched investigations into threats against Department of Governmental Ethics (DOGE) employees, reportedly identifying Senator Chuck Schumer as a target. He is also probing the prosecutorial practices of former U.S. Attorney Matthew Graves, specifically regarding the use of 18 U.S. Code § 1512(c)(2) — a statute leveraged to charge over 1,500 January 6 defendants.

In addition to the inquiry, Martin has reassigned multiple high-profile Biden-era prosecutors to misdemeanor cases in D.C. Superior Court, including those involved in the convictions of Steve Bannon, Peter Navarro, Proud Boys leaders Enrique Tarrio and Ethan Nordean, and Oath Keepers founder Stewart Rhodes. The move, first reported by Politico, was seen by some as a rebuke of partisan prosecutions.

The controversy has intensified as it was reported that, under federal law, if the U.S. Attorney role remains unfilled beyond a certain period, a federal district judge — in this case, Chief Judge James Boasberg — has the authority to appoint a replacement.

Boasberg, who has faced past criticism from conservatives, would have broad discretion to name Martin’s successor if the Senate fails to confirm the nomination by the May 20 deadline.

Among Senate Republicans, several are reported to be withholding support. Senator Mitch McConnell is expected to vote no, while Senators Susan Collins, Thom Tillis, John Cornyn, and Bill Cassidy were named by journalist Lara Logan as potential GOP holdouts. “Why don’t some Republicans want Ed Martin confirmed? What are they hiding?” Logan asked on X.

Greene and others have argued that failure to confirm Martin would enable what they call a “judicial hijacking” of a key federal prosecutorial office. “Republicans can call their senator and urge them to vote for Ed Martin. Don’t let Boasberg pick the next U.S. prosecutor for the District of Columbia,” a statement from supporters read.

Martin’s defenders believe his appointment is critical to restoring accountability in the Justice Department and checking what they describe as politically motivated prosecutions. Critics, however, argue that his actions amount to political retribution and threaten prosecutorial independence.

The Senate Judiciary Committee has not announced whether a final confirmation vote will be scheduled before the looming deadline.
